By registering a professional profile, accessing the web-based manager, printing system QR codes, deploying digital signage configurations, or integrating our order pathways, you confirm that you have read, understood, and agreed to be bound by these operational guidelines. If you are entering into this agreement on behalf of a restaurant group, corporate catering entity, or local commercial establishment, you warrant that you possess the full legal authority to bind that corporate entity to these active terms.
If you do not agree to all provisions of these terms, you must not register an account, upload restaurant assets, generate dynamic code layouts, or utilize any aspect of our cloud-hosted hospitality application.
2. Platform Overview
Digital Menu Maker functions as a professional Software-as-a-Service (SaaS) platform built for the global hospitality and retail food-service industries. The platform provides commercial tools including dynamic QR menu generators, live screen menu boards, contactless table ordering modules, design template customization dashboards, and cloud storage systems.
Our software structures let corporate users upload, compress, translate, and distribute food lists, pricing datasets, images, and visual themes to consumers scanning physical point-of-sale placards. We provide both free access tiers and paid subscription modules with advanced limits and styling features. We reserve the absolute right to modify, upgrade, optimize, or temporarily deprecate platform modules or display patterns to improve global service performance.
3. Restaurant Account Responsibilities
To use our system features, managers must establish an active, validated system profile. You represent that all details submitted during signup—including restaurant trade titles, official corporate names, commercial tax registrations, billing parameters, and primary business locations—are current, complete, and legally accurate.
You hold exclusive responsibility for maintaining the confidentiality of your credentials, password hashes, and staff access roles. Any activities, parameter updates, menu price changes, or legal transactions executed under your administrative dashboard will be deemed fully authorized by your business. You must notify our system engineers immediately if you suspect unauthorized access or database breaches.
4. User Eligibility
Our hospitality SaaS software is offered exclusively to commercial entities, legally organized restaurants, hospitality operators, catering networks, and individual business users of at least eighteen (18) years of age. By creating an administrative profile, you represent that you possess the commercial capacity to enter into legally binding contracts under your local jurisdiction.
Any usage of our design frameworks, QR structures, or ordering portals by individuals who do not meet these age or commercial standards is strictly unauthorized and constitutes a direct breach of these platform guidelines.
5. Subscription & Billing Terms
Specific premium tools across our digital signage systems and ordering systems require an active paid subscription plan. Paid options are billed on a recurring basis (monthly or annually) depending on your selected plan. All pricing tiers, custom feature volumes, dynamic scan caps, and data transfer volumes are detailed on our pricing pages and may be updated periodically.
By subscribing, you authorize Digital Menu Maker to charge your configured payment method for the upcoming billing cycle, along with any applicable regional taxes (such as Indian Goods and Services Tax, international Value Added Taxes, or local sales taxes). Your subscription remains active unless canceled via your manager panel before the next automated renewal date.
6. Payment Processing & Third-Party Billing
We deploy a broad set of payment integrations to support both global and local restaurant operators. Our software works with multiple third-party payment gateways, including:
- Global Gateways: Integration channels including Stripe and PayPal for global business cards.
- Indian Local Gateways: Integration pipelines including Razorpay and Cashfree to process unified payment interfaces (UPI), local net banking, and regional wallet channels.
- Direct Bank Transfers: Options for Indian and global operators to complete direct manual transfers for annual corporate plans.
All direct billing interactions are processed securely through secure APIs. Our servers do not store or process raw credit card numbers or banking credentials. Your financial parameters are processed under the explicit safety conditions of each respective transaction partner.
7. Refund & Cancellation Conditions
You may cancel your recurring SaaS subscription plan at any time through your restaurant management panel. Following cancellation, your premium plan will remain active until the end of your current paid billing period, after which your account will automatically downgrade to our free baseline tier or become inactive.
All paid subscription transactions are final. Since we provide free account levels and direct testing periods to let you evaluate our layout builders, QR targets, and digital board engines prior to upgrading, we do not issue partial refunds, pro-rated cash-backs, or retro-active account credits for partially used billing cycles, except where explicitly required by local consumer legislation.
8. Acceptable Use Rules
Your access to our servers, visual tools, and dynamic databases is governed by strict compliance parameters. You agree that you will not:
- Deploy automated scrapers, data-mining scripts, or high-frequency API crawlers against our menu directories.
- Upload malicious web scripts, system viruses, compromised PDFs, or files containing trojans into our storage networks.
- Publish menus that promote fraudulent operations, illegal services, prohibited substances, or hate speech.
- Reverse engineer, decompile, or copy our dynamic generation templates, layout code, or database structures.
- Circumvent plan limits, modify dynamic QR destination links to bypass scan counters, or exploit visual caching pathways.
Any identified violation of our acceptable use guidelines may result in immediate account restriction, deletion of hosted dynamic menus, and permanent platform ban without prior warning or subscription refund.
9. Uploaded Restaurant Content
Our software lets you upload visual media, culinary copy, descriptions, pricing tables, allergy alerts, and customized logos. You retain full copyright ownership of all text and visual media you upload to our platform.
By publishing your menus, you grant Digital Menu Maker a global, perpetual, royalty-free, and non-exclusive license to host, parse, cache, scale, modify for screen responsiveness, and stream your content across our networks. You warrant that you possess all necessary licensing rights, trademarks, and copyright permissions for all visual media and text uploaded to our system.
10. Intellectual Property Rights
Except for the raw menu content and logo assets uploaded directly by our restaurant clients, all elements on Digital Menu Maker—including our codebase, user interface designs, dynamic generation algorithms, layout templates, generated QR code vector outputs, and logo files—are the exclusive intellectual property of JESASTIC Web Design & IT Solutions.
You are granted a limited, personal, non-transferable, and revocable license to access our B2B SaaS dashboard and display generated menu templates strictly to support your restaurant operations, in accordance with these terms. This license does not grant any rights to resell, white-label, or repackage our visual systems or software services.
11. Copyright & Trademark Protection
We respect the intellectual property rights of creators and expect our restaurant partners to do the same. If you believe any menu hosted on our platform infringes your copyright or registered trademark, please refer to our DMCA Policy page to submit a formal takedown request. We review all submitted infringement claims and take prompt action to remove or restrict unauthorized assets in accordance with applicable copyright laws.
12. Platform Availability
While our infrastructure team strives to maintain a stable hosting environment with 99.9% uptime for our dynamic menu boards and online assets, we do not guarantee uninterrupted system access. Planned maintenance, database migrations, security patches, network failures, or global hosting outages may occasionally cause temporary system downtime.
We do not hold liability for any lost restaurant revenue, transaction disruptions, customer frustrations, or offline displays resulting from service interruptions or slow menu load times.
13. Third-Party Integrations
Our hospitality SaaS software may connect with external platforms, including Point of Sale (POS) hardware, local thermal printers, custom messaging channels, and map locations. These integrations are governed by their respective developers' operational guidelines. We do not control, audit, or assume liability for the performance, data safety, or accurate data transmission of external third-party software connections.
14. Affiliate & Referral Programs
Our marketing programs let approved partners earn commissions by referring new active business subscriptions to Digital Menu Maker. All participants in our referral networks must provide clear, legal disclosures regarding their financial relationships in accordance with our Affiliate Disclosure. We reserve the absolute right to cancel referral commissions, block affiliate accounts, or modify commission rules if we identify fraudulent referrals, search engine manipulation, or program policy violations.
15. Account Suspension & Termination
We reserve the absolute right, without liability, to suspend, limit, or permanently delete your restaurant account and hosted data if:
- You fail to pay subscription fees within seven (7) days of your scheduled billing date.
- You breach any operational rules set out in these terms or our acceptable use guidelines.
- Your menu pages receive persistent spam traffic or generate security alerts on our servers.
- We receive verified copyright, trademark, or legal complaints regarding your uploaded menu content.
Upon termination, your right to access our system dashboards and display hosted menus will cease immediately, and all generated QR codes will automatically deactivate.
16. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall JESASTIC Web Design & IT Solutions, its founders, officers, technical staff, or associated service partners be held liable for any indirect, special, incidental, punitive, or consequential damages. This includes, without limitation, loss of business profits, customer food-allergy disputes, platform transaction errors, kitchen order failures, server downtime, or loss of menu data.
Our total combined liability for any dispute or claim arising from this agreement or your platform usage shall be strictly limited to the total subscription fees paid by your business to Digital Menu Maker during the three (3) month period immediately preceding the event that gave rise to the claim.
17. Warranty Disclaimer
Digital Menu Maker is provided on an "As-Is" and "As-Available" operational basis, without warranties of any kind, whether express, implied, or statutory. We explicitly disclaim all implied warranties, including those of merchantability, fitness for a particular hospitality purpose, system security, or non-infringement.
We make no warranty that our codebase will be free from software errors, that our server speeds will remain uniform across all international locations, or that generated dynamic QR targets will display perfectly on all consumer browsers and legacy mobile devices.
18. Indemnification
You agree to defend, indemnify, and hold harmless JESASTIC Web Design & IT Solutions, its parent group, founders, and operational partners from and against any claims, damages, losses, liabilities, and legal expenses (including reasonable legal fees) arising out of:
- Your direct use of our SaaS software, QR systems, and menu templates.
- Any intellectual property, pricing errors, or inaccurate health warnings contained within your uploaded menu content.
- Any direct breaches of these platform terms, acceptable use policies, or local consumer protection laws.
- Transactions and order fulfillment disputes between your establishment and your dining customers.
19. Governing Law
These terms of service and any disputes arising from your platform usage shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
Any legal actions, dispute resolutions, or litigation associated with this agreement must be filed exclusively in the courts located in Nadia, West Bengal, India. By using our platform, you consent to the personal jurisdiction and venue of these courts for any platform disputes.
20. International Users
Our platform operations are accessible globally. If you use our B2B SaaS tools from outside India, you are responsible for maintaining compliance with all local food-safety standards, consumer pricing disclosures, and regional tax obligations. We operate our servers under strict security controls to ensure reliable operations across different international jurisdictions.
21. Updates To Terms
We reserve the right to modify or replace these terms of service at any time to reflect software changes, regulatory updates, or shifts in our business practices. When we make updates, we will update the "Last Updated" date at the top of this document.
Your continued use of our dashboard, QR templates, and visual boards after any updates take effect constitutes your complete acceptance of the updated terms. If you do not agree to the updated terms, you must close your account and stop using our services.
